"Victorian family provision eligibility has undergone some unique changes over the last few decades, first expansive and then restrictive. In the process, it may have become a ‘test case’ for the impact of eligibility changes in this field of law. While it may be too soon to draw firm conclusions, the shape of the questions that may be asked are taking form. It is also timely to provide this update, as all of you will benefit from an understanding of the present Victorian scheme to more fully understand our appeal decisions in relation to your own jurisdiction’s legislation."
