To many of us estate administration disputes can seem Pythonesque – gravely serious yet often comedic in their depth and nature. The position of Personal Representative, is at times, burdensome, for Beneficiaries, at times, bewildering. The mix frequently results in dispute over the manner in which the estate administration is conducted with both often left floundering for resolution. Introduced by amendments to the UCPRs in 2011 Part 10 is an overlooked yet economic way to resolve these disputes through a quasi – judicial process. Part 10 provides a simple legislative mechanism for both Personal Representatives and Beneficiaries alike, to have their concerns about the conduct of an estate administration aired and resolved.
